This Fair Usage Policy outlines the acceptable and prohibited uses of the CrescoWorks Applicant Tracking System. By using our services, you agree to comply with these terms.

Violation of this Fair Usage Policy may result in immediate account suspension or termination without refund. We reserve the right to investigate suspicious activity and take appropriate action to protect our platform and users.

1. Policy Overview
CrescoWorks provides a premium Applicant Tracking System designed to help organizations streamline their recruitment processes. This Fair Usage Policy ensures that all users can access and benefit from our services without interference from misuse or abuse.
1.1 Scope
This policy applies to:
- All CrescoWorks users, including Free Trial, SaaS, and Enterprise customers
- All features and services provided through the platform
- API usage and integrations
- Data storage and processing activities
- All user accounts, including administrators and team members
1.2 Definitions
Fair Use: Reasonable and legitimate use of CrescoWorks services in accordance with your subscription plan and business needs.
Abuse: Any use of the service that violates this policy, exceeds reasonable limits, or negatively impacts other users or the platform.
2. Usage Limits & Restrictions
2.1 Plan-Based Limits
Your usage must align with your selected pricing tier and annual hiring volume:

2.2 API Rate Limits
To ensure system stability and fair access for all users, the following API limits apply:
- SaaS Plans: 10,000 API calls per day
- Enterprise Plans: 50,000 API calls per day (customizable)
- Burst Limit: Maximum 100 requests per minute
- Concurrent Connections: Maximum 20 simultaneous API connections
2.3 Job Posting Limits
- Active Job Postings: Unlimited within your hiring volume
- Applicants Per Job: Maximum 5,000 applicants per single job posting
- Job Duration: Jobs must be closed within 12 months or marked as evergreen
- Job Reposting: Same job cannot be posted more than 3 times in 30 days
2.4 Per User Activity Limits
To prevent system abuse and ensure fair resource allocation, individual user accounts have the following daily limits:
- Maximum Candidate Profile Views: 500 profiles per user per day
- Maximum Candidate Emails: 200 emails per user per day
- Maximum Profile Updates: 50 candidate profile modifications per user per day
- Maximum Bulk Actions: 100 candidates per bulk action
- Maximum Login Sessions: 5 concurrent sessions per user
- Maximum Export Requests: 10 data exports per user per day
2.5 AI Candidate Creation Limits
To prevent artificial inflation of candidate pools and ensure data quality:
- Manual Candidate Creation: Maximum 50 candidates per user per day
- AI-Generated Profiles: Strictly prohibited – all candidates must be real applicants
- Automated Candidate Import: Maximum 500 candidates per import session
- Duplicate Detection: System will flag and block duplicate candidate entries
- Candidate Quality: Profiles must contain minimum required fields (name, email, resume)
⚠️ Strictly Prohibited: AI-Generated Candidates
Creating fake, AI-generated, or synthetic candidate profiles is strictly forbidden. All candidates must be real individuals who have applied or expressed interest in positions. Violation will result in immediate account termination.
2.6 Storage Limits by User Role
Recruiter/Admin Storage Limits:
- Per User Document Storage: 50GB per recruiter/admin account
- Personal Notes & Files: 5GB per user
- Email Attachments: 25MB per email, 1GB total per user per month
- Template Library: 500 email templates per user
- Saved Searches: 100 saved search queries per user
General User (Hiring Manager/Interviewer) Storage Limits:
- Per User Document Storage: 10GB per general user account
- Interview Notes & Scorecards: 2GB per user
- Personal Files: 1GB per user
- Saved Searches: 25 saved search queries per user
2.4 Email & Communication Limits
- Automated Emails: Maximum 10,000 emails per month per account
- Bulk Communications: Maximum 500 recipients per email campaign
- SMS Notifications: As per purchased credits or plan allocation
3. Prohibited Activities
The following activities are strictly prohibited and will result in immediate action:
3.1 Fraudulent Use
- Creating multiple accounts to bypass plan limits or obtain multiple free trials
- Using false information during registration or billing
- Reselling or redistributing CrescoWorks services without authorization
- Credit card fraud or chargeback abuse
- Exploiting promotional codes or discounts beyond their intended use
3.2 System Abuse
- Attempting to reverse engineer, decompile, or disassemble the platform
- Introducing viruses, malware, or malicious code
- Conducting security penetration testing without written authorization
- Scraping, crawling, or automated data extraction
- Overloading or attempting to disrupt system infrastructure
- Circumventing authentication, security, or usage limits
3.3 Data Misuse
- Uploading or storing illegal, fraudulent, or infringing content
- Harvesting candidate data for non-recruitment purposes
- Sharing or selling candidate information without consent
- Using the platform to send spam, phishing emails, or unsolicited communications
- Storing sensitive data (credit cards, SSNs, medical records) not related to recruitment
3.4 Discriminatory Practices
- Using the platform to discriminate based on protected characteristics
- Creating job postings that violate equal opportunity laws
- Implementing hiring practices that are illegal or unethical
- Filtering or screening candidates based on discriminatory criteria
3.5 Misrepresentation
- Posting fake job listings or ghost jobs
- Impersonating other companies or recruiters
- Collecting candidate information under false pretenses
- Misrepresenting your organization or hiring authority
4. Account Sharing & Multiple Accounts
4.1 Account Ownership
Each CrescoWorks account must be registered to a single organization. Account credentials are confidential and must not be shared outside your organization.
4.2 User Licenses
- Unlimited Users: All plans include unlimited user accounts for your organization
- Definition of Organization: A single legal entity with a unified tax ID/business registration
- Subsidiaries & Branches: May be included under one account if under the same parent company
4.3 Prohibited Account Activities
- Creating multiple accounts for the same organization to bypass plan limits
- Sharing account access with external recruiters, agencies, or third parties
- Creating accounts using personal email addresses (must use corporate email)
- Selling or transferring account access to other organizations
- Using a single account to serve multiple unrelated business entities
5. Data Usage & Storage
5.1 Data Retention
- Active candidate data can be stored indefinitely within plan limits
- Inactive job postings and candidate data may be archived after 24 months
- Upon account cancellation, data is retained for 90 days before deletion
- You must export any required data before account cancellation
5.2 Acceptable Data
You may store and process the following recruitment-related data:
- Candidate resumes, CVs, and application materials
- Interview notes and evaluations
- Communication history with candidates
- Background check results (in compliance with local laws)
- Reference check information
- Offer letters and employment agreements
5.3 Prohibited Data
You must NOT store the following in CrescoWorks:
- Full credit card numbers or financial account information
- Social Security Numbers or national ID numbers (unless legally required and encrypted)
- Medical records or health information unrelated to reasonable accommodations
- Genetic or biometric data
- Content that violates privacy laws (GDPR, CCPA, etc.)
5.4 Data Compliance
You are responsible for ensuring your use of CrescoWorks complies with:
- GDPR (European Union)
- CCPA (California, USA)
- Local data protection and privacy regulations
- Equal employment opportunity laws
- Data retention and deletion requirements
6. Monitoring & Enforcement
6.1 Automated Monitoring
CrescoWorks employs automated systems to monitor for:
- Unusual usage patterns or spikes in activity
- API rate limit violations
- Storage quota exceeded
- Suspicious login attempts or security breaches
- Bulk data extraction or scraping attempts
6.2 Manual Review
We reserve the right to manually review accounts when:
- Automated systems flag suspicious activity
- We receive complaints from candidates or other users
- Legal or regulatory requests require investigation
- Usage patterns significantly exceed plan allocations
6.3 Notification Process
If we detect policy violations, we will typically follow this process:
- Warning: Email notification of potential violation with 48-hour response window
- Throttling: Temporary service limitations if issue persists
- Suspension: Account suspension for serious or repeated violations
- Termination: Permanent account termination for severe violations
7. Consequences of Violation
7.1 Account Suspension
Suspended accounts will:
- Have all platform access disabled immediately
- Retain data for 30 days while under review
- Be required to resolve violations before reactivation
- May face additional charges or plan upgrades
7.2 Account Termination
Terminated accounts will:
- Lose all access permanently
- Forfeit any remaining subscription period (no refunds)
- Have data deleted after 30 days
- Be prohibited from creating new accounts
- May face legal action for damages or fraudulent activity
7.3 Financial Penalties
- Overage Charges: Exceeding plan limits may incur per-hire charges at 2x standard rate
- Fraudulent Use: Accounts using multiple free trials will be charged full price retroactively
- API Abuse: Excessive API usage may incur additional infrastructure fees
- No Refunds: Violations resulting in termination forfeit all payments
7.4 Legal Action
We reserve the right to pursue legal action for:
- Fraud, theft, or financial crimes
- Copyright or trademark infringement
- Data breaches or security violations
- Damage to our platform, reputation, or other users
- Violation of applicable laws or regulations
